1. Introduction
Welcome to OpenCommunityAtlas ("we," "us," or "our"). These Terms & Conditions ("Terms") are in place to manage your utilization of our yacht charter service and our website found at opencommunityatlas.com (the "Service"), which is provided by OpenCommunityAtlas.
By reserving a charter or using our Service, you accept these Terms. Should you disagree with any section of these terms, you are not permitted to use the Service.
2. Service Overview
OpenCommunityAtlas offers a variety of high-end yacht charter services, which comprise:
- Yacht rentals for the day
- Evening sailing events
- Corporate retreats
- Exclusive gatherings
- Yacht charters over several days
Our services are subject to availability and may be influenced by weather conditions. We retain the right to alter or stop services at our discretion.
3. Booking and Reservations
3.1 Booking Process
When you make a reservation for a charter, you must follow the steps below:
- Be of 18 years or older
- Provide valid and complete personal details
- Make a deposit payment as outlined in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Reservation confirmation is contingent upon payment receipt and our subsequent written confirmation. We hold the right to deny service at our own judgment.
3.3 Availability
Charter reservations are dependent on the accessibility of the vessel and favorable weather conditions. We aim to accommodate your requested dates and timings to the best of our ability.
4. Payment Terms
4.1 Pricing
All quoted charges are in € and cover all applicable taxes unless stated otherwise. Prices are subject to modification without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the overall charter cost is required at the time of reservation
- Remaining balance: Must be settled 48 hours prior to the departure of the charter
- Any additional fees (if applicable): Are settled post charter completion
4.3 Payment Methods
We accept a variety of payment methods such as major credit cards, bank wire transfers, and certified cheques. Payment procedures are processed using secure, encrypted technology.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancelled prior to 72 hours before departure: Full refund except for processing fees
- If cancelled between 24 to 72 hours before departure: 50% refund
- If cancelled less than 24 hours before departure: No refund granted
5.2 Weather Cancellations
Should the captain deem weather conditions as unsafe, we will propose either:
- A rescheduled charter on a subsequent available date without any additional cost
- A complete refund in case rescheduling is not an option
5.3 Mechanical Issues
If mechanical issues arise with the allocated vessel, our efforts will be to provide a suitable alternative. Should an alternative not be available, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are required to:
- Obey all instructions from the crew
- Utilize safety equipment as necessary
- Inform about any health conditions that may impact their safety
- Stay within the permitted areas of the yacht
6.2 Prohibited Items
The following items are prohibited on the yacht:
- Containers made of glass
- Illicit substances
- Weapons or firearms
- Excessive non-alcoholic beverages beyond reasonable consumption
- Pets (with the exception of pre-approved cases)
6.3 Conduct
Passengers are expected to behave respectfully. Any charter may be ended prematurely without a refund if passenger behavior constitutes a safety hazard or disrupts the experience for other guests.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the cost paid for your charter. We assume no responsibility for:
- Injuries incurred due to passenger recklessness
- Damage or loss of personal items
- Indirect damages, consequential or punitive
- Delays that result from weather or unavoidable circumstances beyond our control
7.2 Insurance Coverage
Our vessels and operations are protected with comprehensive marine insurance. Travel and personal insurance is the passenger's responsibility.
7.3 Assumption of Risk
By partaking in our services, you acknowledge that activities on the water inherently present risks and you assume accountability for your safety and health.
8. Modifications and Itinerary Changes
It is within our rights to alter travel itineraries, courses, or schedules due to safety considerations, weather conditions, or operational necessities. We will endeavor to provide equivalent alternate experiences wherever feasible.
9. Force Majeure
We will not be held accountable for any hold-ups, cancellations, or changes brought about by conditions out of our control, including, but not confined to:
- Extreme meteorological conditions
- Natural catastrophes
- Regulatory enactments by the government
- Closures of harbors or ports
- Failure of machinery
10. Privacy and Data Protection
We commit to treating your personal details in line with our Privacy Policy. You consent to the gathering and usage of your data as outlined in our Privacy Policy by availing our services.
11. Intellectual Property
The intellectual content on our website, such as text, graphics, logos, and imagery, is protected under copyright and innovative property laws. Unauthorized reproduction, distribution, or derivative creation is prohibited without our explicit consent.
12. Governing Law
The laws of Monaco are applicable to these Terms, and any disputes will be adjudicated in the courts housed in Monte Carlo, Monaco.
13. Changes to Terms
We hold the right to amend these Terms as needed. Any amendments will be communicated via our website with a revised date of issue. Your continued use of our services signifies your agreement to the revised terms.
